1. Who we are

Punicai (the "Platform") provides creators with a branded member portal: a searchable library of their own content, an AI assistant grounded only in that content, and member subscriptions the creator prices themselves.

The Platform is a service provider to creators. Each creator (the "Creator") is independently responsible for the content published on their site, for the claims made in it, and for their relationship with their own members.

By creating an account, subscribing, or otherwise using the Platform you agree to these terms. If you do not agree, do not use the service.

2. Definitions

• "Platform" — the software, websites and services operated by Punicai.
• "Creator" — the account holder who publishes content on a site hosted by the Platform.
• "Member" — a person with an account on a Creator's site.
• "Content" — text, audio, video, images and any other material published on a site.
• "Subscription" — a paid tier granting a Member access to some or all of a Creator's Content.

3. Accounts and eligibility

You must be old enough to enter a binding contract in your country of residence, and you must provide accurate registration details. You are responsible for everything done through your account and for keeping your sign-in method secure.

An account belongs to one Creator's site. The same email address may hold separate accounts on different Creators' sites; those accounts are unrelated and do not share data.

We may suspend or close an account that breaches these terms, and a Creator may remove a Member from their own site.

4. Subscriptions, payments and renewals

Prices are set by each Creator and shown before purchase. Payment is processed by our payment provider; we do not store your full card details.

• Monthly plans renew automatically until cancelled.
• Three-, six- and twelve-month plans are prepaid one-time purchases. They do not renew automatically and end at the close of the period.
• One-time support payments are voluntary and grant no subscription or tier.

You may cancel auto-renewal at any time from your account page. Cancelling stops the next charge; access continues until the end of the period you have already paid for.

Payments are collected on behalf of the Creator, who receives them directly. The Platform may retain a service fee.

5. Refunds

Except where a refund is required by the consumer law that applies to you, payments are non-refundable once the billing period has begun. If you believe you were charged in error, contact us and we will investigate.

6. Content and intellectual property

Content published on a Creator's site belongs to that Creator (or to their licensors). A Subscription grants you a personal, non-transferable, non-exclusive licence to access that Content for your own use while your Subscription is active.

You may not copy, redistribute, resell, publicly perform, or use Content to train a machine-learning model, without the Creator's written permission.

The Platform itself — the software, design and trademarks — remains ours.

7. Acceptable use

You agree not to:

• share your account or sign-in link with others;
• attempt to download, scrape or bulk-export a Creator's library;
• probe, disrupt or circumvent the security of the Platform;
• upload unlawful material, or material you have no right to publish;
• harass other Members, or misuse community features.

8. The AI assistant

The assistant answers only from the Creator's own published Content. It is an automated tool: it can be wrong, incomplete, or out of date, and it does not speak for the Creator personally.

Answers are provided for information only. They are not professional advice, and specifically not medical, legal, financial or psychological advice. Do not act on an answer where professional advice is warranted — consult a qualified professional.

Usage may be limited by the tier you hold. Requests that reach the model count toward your allowance even if the model then returns an error.

9. Privacy and data

We process your account details, your activity on the site, and the questions you ask, in order to operate the service. Creators can see activity on their own site. Creators are separated from one another: one Creator can never see another Creator's Members or Content.

We use third-party processors for hosting, payments, transcription, email and AI inference. We do not sell personal data.

You may request access to, correction of, or deletion of your personal data by contacting us.

10. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted operation. Features may be added, changed or withdrawn. A Creator may change their tiers and pricing; a change to a price you are already paying takes effect at your next renewal, not mid-period.

We may amend these terms. Material changes will be notified on the site, and continued use after that constitutes acceptance.

11. Limitation of liability

To the fullest extent permitted by law, the Platform is provided "as is" and we exclude all implied warranties. We are not liable for indirect or consequential loss, for loss of profit, or for a Creator's acts or omissions. Where liability cannot be excluded, it is limited to the amount you paid in the twelve months before the claim.

Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

12. Termination

You may stop using the service at any time and close your account from your account page. We may suspend or terminate access for a material breach of these terms. Provisions that by their nature survive termination — intellectual property, liability, and governing law — continue to apply.

13. Governing law and contact

These terms are governed by the law of the jurisdiction in which the Platform operator is established, and disputes are subject to the exclusive jurisdiction of its courts.
